1. Introduction & Acceptance

Balutedaar (OPC) Private Limited (“Balutedaar”, “Company”, “We”, “Us”) is the lawful owner and operator of the brand Balutedaar and the website www.balutedaar.com (“Website” or “Site”).

By accessing, browsing, registering, or transacting on the Website, you (“User”, “Customer”, “You”) acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions, along with all applicable laws of India.

If you do not agree, you must discontinue use of the Website immediately.

2. Eligibility to Use

  • Services are available only within select geographical locations in India.

  • Persons who are not competent to contract under the Indian Contract Act, 1872, including minors, un-discharged insolvents, or persons of unsound mind, are not eligible to use the Website.

  • Users between 13 and 18 years may use the Website only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

  • The Company reserves the right to refuse access or terminate accounts at its sole discretion.

3. User Account & Registration

  • Registration is mandatory to place orders.

  • You agree to provide true, accurate, and complete information and to keep your account details updated.

  • You are solely responsible for maintaining the confidentiality of your login credentials.

  • Any activity carried out through your account shall be deemed to have been done by you.

  • Balutedaar shall not be liable for any loss arising from unauthorised access due to your negligence.

4. Personal Information & Data Usage

Balutedaar may collect personal and usage data including but not limited to name, contact details, address, demographic data, browsing behaviour, and transactional history.

Such data shall be processed in accordance with applicable Indian laws and Balutedaar’s Privacy Policy.

By using the Website, you consent to such collection and use for lawful business purposes.

5. License & Website Access

Balutedaar grants you a limited, revocable, non-transferable license to access the Website for personal, non-commercial use only.

You shall not:

  • Reproduce, copy, sell, resell, or exploit any portion of the Website

  • Frame or misuse trademarks, logos, or proprietary information

6. Pricing & Product Information

  • Prices displayed at the time of order confirmation shall be final.

  • Product descriptions are indicative and subject to natural variations.

  • Balutedaar reserves the right to modify prices, products, or availability without prior notice.

  • No assurance is given that product images or colours displayed will exactly match actual items.

7. Order Cancellation

  • Once an order is successfully placed and confirmed, it cannot be cancelled by the Customer as a matter of right.
  • However, the Customer may submit a written cancellation request by email to care@balutedaar.com. Any such request shall be considered solely at the discretion of Balutedaar, and approval, if any, shall depend upon the stage of order processing, procurement, or operational feasibility.
  • Balutedaar shall have no obligation to accept cancellation requests once order processing, farmer procurement, or logistical arrangements have commenced.
  • Notwithstanding the above, Balutedaar reserves the absolute right to cancel any order, without assigning reasons and without liability, where such order is suspected to be fraudulent, abusive, erroneous, or in violation of these Terms & Conditions.
  • The Company may maintain internal records of misuse or abuse of the platform and reserves the right to restrict, suspend, or permanently deny access to such Users.

8. User Obligations & Representations

You agree and confirm that:

  • All information provided is accurate and lawful

  • You shall comply with all applicable laws and regulations

  • You will not misuse the Website or services

  • You accept full responsibility for your decisions and transactions

  • Incorrect delivery details provided by you shall be your sole responsibility, including additional costs incurred

9. Prohibited Activities

You shall not use the Website for:

  • Unlawful, abusive, defamatory, obscene, or offensive content

  • Infringing intellectual property rights

  • Hacking, data interference, or unauthorised access

  • Disrupting Website functionality

12. Disclaimer of Liability

  • Balutedaar makes no warranties regarding uninterrupted or error-free operation.

  • The Company shall not be liable for indirect, incidental, consequential, or economic losses.

  • Users access and transact at their own risk and judgment.

13. Indemnity

You agree to indemnify and hold harmless Balutedaar, its directors, officers, employees, and agents from all claims, losses, damages, liabilities, and expenses arising from:

  • Your breach of these Terms

  • Violation of applicable laws

  • Infringement of third-party rights

  • Misuse of the Website

This clause shall survive termination.

14. Termination

Balutedaar may suspend or terminate your access at any time, without notice or liability, for violation of these Terms or applicable law.

Termination shall not affect obligations incurred prior thereto.

15. Modification of Terms

Balutedaar reserves the right to modify these Terms at any time. Continued use of the Website constitutes acceptance of revised Terms.

16. Governing Law, Jurisdiction & Arbitration

These Terms shall be governed by the laws of India.

  • Arbitration shall be conducted under the Arbitration and Conciliation Act, 1996

  • Seat and venue of arbitration: Pune, Maharashtra

  • Courts at Pune shall have exclusive jurisdiction

  • Subject to arbitration, the High Court of Judicature at Bombay shall have supervisory jurisdiction

17. Severability

If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force.

18. Entire Agreement

These Terms constitute the entire agreement between the User and Balutedaar concerning use of the Website.
